Welcome to hllplanner.net ("we," "us," "our," or "the Service"). These Terms of Service ("Terms") govern your access to and use of our website, applications, and services (collectively, the "Service").

By accessing or using the Service, you ("you" or "User") agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

1. Your Account and Eligibility

  • Age Requirement: You must be at least thirteen (13) years of age to use the Service. If you are in the European Economic Area (EEA) or United Kingdom, you must be at least sixteen (16) years of age, or the age required by your country's laws to consent to data processing.
  • Minors: We do not knowingly collect or solicit personal information from anyone under the age of 13. If we learn that we have collected personal information from a child under 13, we will take steps to delete that information as quickly as possible.
  • Account Creation: You must create an account to access certain features. We use Discord OAuth2 for authentication. You grant us permission to access your Discord ID, username, and avatar as specified in our Privacy Policy.
  • Account Responsibility: You are responsible for all activity that occurs under your account.

2. The Service

We provide a Software-as-a-Service (SaaS) platform that allows authorized users to connect to their game servers to collect, manage, and display player and server data.

3. Server Credentials and Security

  • To use the Service, you must provide connection credentials (such as RCON passwords or other API keys) for your game servers. We will store these credentials in an encrypted format.
  • You represent and warrant that you are an authorized administrator of any server you connect to the Service and have the right to provide these credentials.

4. User-Generated Content

  • You may upload content, such as team images and text descriptions ("User Content").
  • You retain all ownership rights to your User Content. By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, and display your User Content solely for the purpose of operating the Service.

5. Data Processing and Your Responsibilities

This section defines our roles under data protection laws like the GDPR.

  • Your Role (Data Controller): For the personal data of the players on your game servers (e..g, Steam IDs, usernames) that you collect and provide to our Service, you are the "Data Controller."
  • Our Role (Data Processor): We are the "Data Processor" for that player data. We only process it according to your instructions (i.e., your use of the Service).
  • Your Warranties: As the Data Controller, you represent and warrant that:
    • You have a lawful basis (e.g., consent from your players, or legitimate interest) to collect this player data and transfer it to us for processing.
    • You will honor all requests from your players regarding their data, including requests for access, correction, and deletion (erasure).
    • You will not use the Service to collect data from any person under the age of 13.

6. Payments and Subscriptions

  • Fees: Certain features of the Service may require payment.
  • Payment Processor: We use Stripe, Inc. ("Stripe") as our third-party payment processor. By making a payment, you agree to be bound by Stripe's Services Agreement. We do not store or process your credit card details.
  • Cancellations: You may cancel your subscription at any time. All payments are non-refundable, except as required by law.

7. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose.
  • Upload any content that is malicious, defamatory, obscene, or hateful.
  • Attempt to reverse-engineer, decompile, or gain unauthorized access to the Service.

8. Termination

  • By You: You may terminate your account at any time by contacting us at [email protected].
  • By Us: We reserve the right to suspend or terminate your account at any time, without notice, if you breach these Terms.
  • Effect of Termination: Upon termination, your account will be disabled. We will delete or anonymize all Personal Information associated with your account, including your Discord ID, encrypted server credentials, and all Player Data (e.g., Steam IDs) collected by your account, in accordance with our Privacy Policy. Anonymized historical data, which is no longer personally identifiable, may be retained for analytical purposes.

9. Disclaimers and Limitation of Liability

  • Disclaimer of Warranties: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
  • Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL hllplanner.net (OR ITS OWNER) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.
  • Cap on Liability: IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNTS PAID BY YOU TO US IN THE PAST SIX (6) MONTHS.

10. Governing Law

These Terms shall be governed by the laws of the State of North Carolina, without regard to its conflict of law provisions.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by posting the new Terms on our site.
